Class Action Waiver

Any arbitration or legal action under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and MCIT agree otherwise, the Arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Customer consents to the exclusive jurisdiction and venue of the state and federal courts located in Hartford County, State of Connecticut, USA.  The Parties shall seek a mutually agreeable mediation as a first effort to resolve a dispute.  EACH PARTY HEREBY WAIVES ANY RIGHT TO A JURY TRIAL.

  3. No waiver of any right under this Agreement shall be valid or enforceable unless in writing signed by the granting Party, and any such waiver granted shall be valid only for a given instance.
  4. The provisions of this Agreement are intended to be severable, and if any provision is held to be unenforceable under any rule of law, the other provisions shall remain in force and shall not be affected thereby.
  5. Neither Party shall assign any rights or obligations hereunder without 30 days' notice and the express written consent of the other Party, and any attempt to do so in contravention of this provision shall be void.
